planetary defense only for defending faction

At the moment you can have your planetary defenses in battle if you attack a neutral planet(no faction has more than 50%). You must only attack first. Second faction (who has also defense on this planet) who attacks has to fight against it. I think this isnt fair. In my opinion both factions attack a neutral planet. Why one faction should have extra defense?

That's because currently defenses are not destroyed when the occupation goes below 50%.
